1. Acceptance of Terms

These Terms of Use ("Terms") govern your use of the Trend Labs: Video & Art mobile application ("App"). By accessing or using the App, you confirm that you are at least 13 years of age and agree to these Terms and our Privacy Policy.

2. License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on your personal Apple device solely for your personal, non-commercial purposes.

You may not:

• Copy, modify, or distribute the App
• Reverse engineer or decompile the App
• Use the App for commercial purposes without our written consent
• Remove any proprietary notices or labels on the App
• Use the App in any way that violates applicable laws or regulations

3. In-App Purchases and Subscriptions

The App offers in-app purchases and subscriptions, including:

• Weekly Subscription: $3.99/week
• Monthly Subscription: $4.99/month
• Yearly Subscription: $34.99/year
• Credit Packs: Various options for one-time purchases

All purchases are processed through Apple's App Store. By making a purchase, you agree to Apple's payment terms. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You may manage and cancel subscriptions in your Apple Account settings.

No Refunds: All purchases are final except as required by applicable law or Apple's refund policy. We do not issue refunds for unused subscription periods or purchased credits.

4. User Content

You retain ownership of any photos, videos, or other content you upload to the App ("User Content"). By uploading User Content, you grant us a limited, temporary license to process your content solely for the purpose of providing the App's AI generation features.

You represent and warrant that:

• You own or have the right to use and upload your User Content
• Your User Content does not infringe any third-party intellectual property rights
• Your User Content does not contain material that is illegal, harmful, or offensive
• You have obtained consent from any individuals depicted in your User Content

5. Prohibited Uses

You agree not to use the App to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, or defamatory
• Create deepfakes or misleading content without the consent of depicted individuals
• Generate content involving minors in any inappropriate manner
• Infringe copyrights, trademarks, or other intellectual property rights
• Distribute spam, malware, or engage in phishing
• Attempt to gain unauthorized access to our systems
• Violate any applicable local, state, national, or international law

6. AI-Generated Content

The App uses artificial intelligence to generate content. You acknowledge that:

• AI-generated content may not always be accurate, appropriate, or suitable for all purposes
• You are responsible for how you use AI-generated content
• We do not guarantee the accuracy, quality, or appropriateness of AI-generated outputs
• AI-generated content may not be used for illegal, harmful, or misleading purposes

7. Intellectual Property

The App, including its design, code, features, and content, is owned by us and protected by intellectual property laws. The Trend Labs name, logo, and related marks are our trademarks. Nothing in these Terms grants you any right to use our intellectual property without our prior written consent.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Termination

We reserve the right to suspend or terminate your access to the App at any time, for any reason, without notice. Upon termination, your license to use the App will immediately cease.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by updating the date at the top of this page or through an in-app notification. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through binding arbitration or in courts of competent jurisdiction.

13. Apple App Store Additional Terms

The following terms apply with respect to Apple as the distributor of the App via the App Store:

• These Terms are between you and us, not between you and Apple
• Apple is not responsible for the App or its content
• Apple has no obligation to provide maintenance or support for the App
• In the event of any failure of the App to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any)
• Apple is a third-party beneficiary of these Terms and has the right to enforce them against you
